These Terms of Service (“Terms”) govern your access to and use of the TIZYY website, platform, and related services (collectively, the “Services”). By creating an account, using the Services, or connecting a WhatsApp Business Account, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

TIZYY provides a WhatsApp Business management platform that allows businesses to send and receive messages, manage contacts, create message templates, run broadcast campaigns, automate conversations, and analyze messaging performance using the official Meta WhatsApp Cloud API.

You must be at least 18 years old and legally authorized to act on behalf of your business to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, complete, and up-to-date information.

You agree to use the Services only in compliance with these Terms, applicable laws, and Meta’s WhatsApp Business Terms of Service and Messaging Policy. Specifically, you must:

• Obtain proper opt-in consent before sending WhatsApp messages to users.
• Respect opt-out, STOP, and unsubscribe requests promptly.
• Not send spam, misleading, fraudulent, abusive, harmful, or illegal content.
• Not use the Services to harass, impersonate, or infringe on the rights of others.
• Not attempt to reverse-engineer, disrupt, or overload the Services or Meta’s infrastructure.

We reserve the right to suspend or terminate accounts that violate these rules or that cause harm to message recipients or platform reputation.

Certain features of the Services require payment. Fees are described on our pricing page or in your subscription plan. Billing is handled by third-party payment processors. You are responsible for all applicable fees, taxes, and charges. Subscriptions may renew automatically unless cancelled before the renewal date.

TIZYY operates as a technology provider using the Meta WhatsApp Business Platform. Your use of WhatsApp-related features is also subject to Meta’s terms, policies, and approval processes. We are not responsible for Meta’s platform availability, rate limits, approval decisions, or changes to Meta’s APIs or policies.

TIZYY and its licensors own all rights, title, and interest in the Services, including all software, designs, trademarks, and content. You retain ownership of the content and data you provide. You grant us a limited license to use your content solely to operate and improve the Services.

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, fail to pay fees, or if required by law or Meta policy. Upon termination, your right to use the Services ceases, and we may delete or retain data in accordance with our Privacy Policy and legal obligations.

The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.

To the fullest extent permitted by law, TIZYY and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold harmless TIZYY, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your use of the Services, your content, or your violation of these Terms or applicable laws, including misuse of WhatsApp messaging or failure to obtain recipient consent.
